Kenneth K. S. YUNG (LL.B. (Hons.), LL.M.)

Managing Partner

PROFILE

Kenneth is a dedicated and compassionate family lawyer with over 20 years of experience in the legal sector.

Prior to joining Hastings & Co., Kenneth was a key member in a leading family and matrimonial law specialist firm in Hong Kong from 2006 to 2016, having acted for various high and ultra-high net worth clients on matters involving cross-border and complex divorce, jurisdictional and forum disputes, nuptial agreements, wealth protection, will drafting, estate planning, financial settlements, spousal and child maintenance claims, enforcement actions as well as children related applications. Kenneth was appointed a member of the Family Law Committee of the Law Society of Hong Kong in 2016, and recognised as a Recommended Lawyer in the 2024 Doyle’s Guide Leading Family & Divorce Lawyers of Hong Kong.

In one of his most notable cases, Kenneth acted for the wife in commencing divorce proceedings in Hong Kong and to resist the husband’s challenge to the jurisdiction of the Hong Kong Court seeking a stay of the Hong Kong proceedings. This forum dispute case involving nuptial agreements later proceeded to the Court of Appeal and thereafter the Court of Final Appeal, eventually became the landmark decision of SPH v SA [2014] 3 HKLRD 497 where the Court of Final Appeal ruled in favour of the wife and confirmed that Hong Kong Courts should follow the principles laid down by the English Supreme Court in Radmacher v Granatino.

After joining Hastings & Co., Kenneth continues to provide legal advice on matters involving matrimonial and family law both to individual clients and corporate clients such as private schools and financial institutions.  Having taken the lead role in the firm’s Private Wealth team, Kenneth extends his practices to private wealth related matters and end-of-life services such as wealth protection, estate planning, wills and succession, probate and estate administration, contentious and non-contentious probate, disputes relating to validity of will, disputes relating to mental capacity, enduring power of attorney, applications under Part II of the Mental Health Ordinance, as well as advising on the setup and administration of Trust with major banks and trust companies.

Given family law proceedings and private client related matters are among the most confidential and sensitive areas of the legal practices, designed to protect the privacy, reputation and emotional well-being of families and children, Kenneth was also invited to join the Working Party on Data Privacy and Records Management in 2019, which later became the Privacy and Data Law Committee of the Law Society of Hong Kong in 2024.

Kenneth currently sits as a committee member on the Family Law Committee, the Family Office Practice Committee, the Privacy and Data Law Committee, the Sports Law Committee and the Practice Management Committee of the Law Society of Hong Kong.
